The Supreme Court’s ruling in Bostock v. Clayton County, GA, has clarified that Title VII of the Civil Rights Act of 1964 and its amendments protect all citizens because of their sex such that it includes all members of the Lesbian, Gay, Bisexual, Queer, and Transgender community!
This ruling is long overdue and the certainty that discrimination claims because of sexual orientation and gender identity may be heard in a Court of law is welcome progress in the fight to end workplace discrimination!
LGBTQ Equal Rights — Birmingham, AL — Allen D. Arnold Attorney at Law
I am happy to consult with you or someone you love about discrimination in the workplace that has occurred because of sexual orientation or gender identity.
However, the statute of limitations on these claims remains unchanged. Time matters, so if you have suffered discrimination in the past 180 days because of your sexual orientation or because you live your life as your true self please call now. Once the 180-day period expires, the potential claim expires forever.
An employer cannot commit an adverse employment action against an employee for discriminatory reasons, such as:
  • Termination
  • Demotion
  • Failure to promote
  • Reduction in work hours
  • Unfavorable job assignments
  • Involuntary transfers
This means that employees have the right to sue employers who have engaged in discrimination, and to seek monetary damages and attorney’s fees.
